Understanding Oklahoma’s Manslaughter Charges
A prosecutor can charge a homicide as first-degree manslaughter under Okla. Stat. tit. 21 § 24-711. Under that statute, homicide is manslaughter when:
- 1) Someone dies in the commission not by design during the commission of a misdemeanor;

- 3) Perpetrated unnecessarily either while resisting an attempt by the person killed to commit a crime, or after such attempt shall have failed.
The law defines second-degree manslaughter (Okla. Stat. tit. 21 § 24-716) as every killing of one human being by the act, procurement or culpable negligence of another, which, under the provisions of this chapter, is not murder, nor manslaughter in the first degree, nor excusable nor justifiable homicide.
The minimum sentence of 1st degree manslaughter is 4 years in prison. Judges may impose higher penalties at the court’s discretion, often depending on the facts of a case.
